These Terms of Service (“Terms”) govern your access to and use of Delfin (the “Service”), a product operated by Gushwork. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The service

Delfin helps buyers describe a sourcing requirement, discover suppliers who may be able to fulfill it, and send quote requests. Supplier listings and details are generated from publicly available information and automated analysis.

Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for ensuring your use complies with applicable laws and any obligations of the organization you represent.

Acceptable use

You agree not to:

• Submit unlawful, fraudulent, infringing, or harmful requests.
• Use the Service to send spam, harass suppliers, or misrepresent your identity or intentions.
• Scrape, overload, reverse-engineer, or interfere with the Service or its underlying systems.
• Use the Service to build a competing dataset or product.

Supplier information and no endorsement

Supplier information is compiled from public sources and automated systems and may be incomplete or inaccurate. We do not endorse, vet, or guarantee any supplier. You are responsible for independently verifying a supplier's credentials, capabilities, pricing, and suitability before entering into any agreement.

No party to transactions

Delfin facilitates discovery and outreach. Any quote, negotiation, contract, payment, or transaction is solely between you and the supplier. We are not a party to, and are not responsible for, those dealings.

Intellectual property

The Service, including its software, design, and branding, is owned by Gushwork and protected by applicable laws. These Terms do not grant you any rights to our trademarks or content except as needed to use the Service.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will meet your requirements.

Limitation of liability

To the maximum extent permitted by law, Gushwork will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business, arising from your use of the Service. Because the Service is provided free of charge, our total liability for any claim is limited to the greater of the amount you paid us (if any) or USD $100.

Changes

We may modify the Service or these Terms at any time. We will update the date above when we make changes; continued use after changes take effect constitutes acceptance.

Governing law

These Terms are governed by applicable law in the jurisdiction in which Gushwork operates, without regard to conflict-of-laws principles.
